Safety Professionals and Competent Persons face potential personal civil and criminal legal liabilities at the worksite for their action and inaction in response to certain hazards on a daily basis. The session will cover these liabilities under federal law (OSHA) and state law ( criminal law, negligence, breach of contract, other liability theories). It will also provide practical advice on how to limit these liabilities through recognized written contract and other disclaimers as well as certain work practices and procedures which should be implemented and enforced. A Labor and Employment Attorney, who specializes in occupational safety and health law and related employment law and personal injury litigation, will present on this topic.
